ABEL AUCTIONS - CONDITIONS OF SALE
Deceased estate furniture, office equipment, refrigerated vending machines, ex 'demo' air conditioners, as new fridges, washing machines + new ballet shoes and much more...  Saturday 26th July starting at 10.30 a.m.

1. Whilst every care has been taken in the compilation of this catalogue the Auctioneers do not accept any responsibility for any misdescription and make NO WARRANTY OR GUARANTEE whatsoever. No error, omission or misdescription or improper or imperfect description in the particulars or in the advertisements, circulars or posters or at the time of sale shall invalidate the sale nor shall they be the subject of a claim by any Purchaser after the sale.
2. Some lots are classified as Money Back Monday (MBM)*. If these lots are faulty and return by 12 noon Monday 28th July 2003 the hammer price and buyers premium will be refunded. All fridges/ freezers should be transported in a vertical position. Any "Money Back Monday" status will be void if said items are transported otherwise.
3. NO WARRANTY OR GUARANTEE is given as to the condition of the stores, equipment, plant or vehicles offered. All items have been available for inspection and it is the buyers responsibility to form his/her own assessment of the conditions of the items on which he/she bids. Unless classified as "Money Back Monday" (MBM) all items are sold AS IS and are to be taken with all faults (if any) and are not returnable for any reason whatsoever.
4. Lots will be at the buyers risk on the fall of the hammer.
5. Members of the public attend at their own risk. Responsibility is NOT accepted for any accident or damage to persons or private property.
6. The highest bidder shall be the Purchaser EXCEPT where there is a reserve price.
7. The vendor shall have the right to bid either by the Auctioneer or by the vendors agent for any lot offered.
8. The Auctioneer may without giving any reason therefore refuse to accept the bid of any person(s) and may decline the offer for any lot or withdraw any lot or lots from sale.
9. Should any dispute arise as to any bid the relevant lot(s) may, at the option of the Auctioneer, be put up again and resold.
10. Each Purchaser shall immediately after any lot is knocked down give to the Auctioneer’s clerk his or her name or bidding number and pay a deposit nominated by the Auctioneer.
11. The Auctioneer reserves the right to refuse any payment for any lot other than by cash unless by arrangement.
12. All items shall be immediately paid for after the sale and delivery of any lots shall not be given to the Purchaser during the sale unless otherwise indicated by the Auctioneer.
13. The delivery of all lots shall be given until 1 hour after completion of the sale or until 3 p.m. on the day of the sale (whichever is the latter) only, unless other arrangements have been made with the Auctioneer.
14. All lots shall be paid for and collected by the Purchasers by the specified time after which time they shall be deemed to be forfeited by the Purchaser and the Auctioneer then has the right to offer such lot or lots not so collected for re-sale whereupon the Purchaser shall forfeit all claim to such lots purchased by him.
15. Buyers accept responsibility for all damage or injury whatsoever to property or persons arising out of or in the course of the removal of lots respectively purchased by them.
16. Unless otherwise announced by the Auctioneer the amount of the accepted bid will be inclusive of GST.
17. Should any deficiency arise between the quantity of goods described at the time of the sale and that available at the time for delivery, the Purchaser shall take and the vendor is required to effect delivery of only the quantity actually available. Financial adjustment will not be paid in the respect of any such deficiency.
18. The Auctioneer will not hold himself responsible for any action that may arise in as much as he is acting solely as agent for the vendor.
19. TERMS STRICTLY CASH OR CERTIFIED BANK CHEQUE BEFORE DELIVERY. 11% buyers premium (inclusive of GST) will apply to all lots. PAYMENT REQUIRED BEFORE 3 P.M. DAY OF SALE.
